Car Rental Agreement -
Terms and Conditions
1. Definitions
• Company: [Your Car Rental Company Name]
• Renter: The individual or entity renting the vehicle.
• Vehicle: The car rented by the Company to the Renter, as described in the rental agreement.
2. Rental Period
• The rental period is defined in the rental agreement, starting from the date and time the vehicle is picked up and ending when the vehicle is returned to the designated location.
• Any extension of the rental period must be approved by the Company and may incur additional charges.
3. Rental Charges
• The rental charges are specified in the rental agreement and must be paid in full at the start of the rental period.
• Additional charges may apply for extra services such as GPS, child seats, or additional drivers.
4. Security Deposit
• A refundable security deposit is required at the start of the rental period. The amount is specified in the rental agreement.
• The deposit will be refunded upon return of the vehicle in the same condition as when rented, minus any charges for damages, fuel, or other expenses.
5. Use of the Vehicle
• The Renter agrees to use the vehicle only for lawful purposes.
• The vehicle must not be used for racing, towing, or transporting goods or passengers for hire.
• The vehicle must not be taken off-road or outside Mauritius without prior written consent from the Company.
6. Driver Requirements
• The Renter and any additional drivers must hold a valid driver’s license recognized in Mauritius and meet the age requirements specified by the Company.
• Additional drivers must be registered with the Company and listed in the rental agreement.
7. Insurance
• The vehicle is covered by a comprehensive insurance policy. Details of the coverage and any deductibles are provided in the rental agreement.
• The Renter is responsible for any damages not covered by insurance, including those resulting from negligence or violations of the rental agreement.
8. Maintenance and Repairs
• The Renter is responsible for maintaining the vehicle in good condition and reporting any mechanical issues to the Company immediately.
• Unauthorized repairs are not permitted. In the event of a breakdown, the Company will arrange for necessary repairs.
9. Fuel
• The vehicle is provided with a full tank of fuel and must be returned with a full tank. Refueling charges will apply if the vehicle is not returned with a full tank.
10. Traffic Violations
• The Renter is responsible for any traffic violations or fines incurred during the rental period.
• The Company will charge an administrative fee for handling such violations.
11. Accidents and Theft
• In the event of an accident, the Renter must contact the Company and local authorities immediately.
• The Renter must provide a complete accident report and cooperate with any insurance investigations.
• In case of theft, the Renter must report to the Company and the police immediately and provide a police report.
12. Termination of Agreement
• The Company reserves the right to terminate the rental agreement and repossess the vehicle if the Renter violates any terms and conditions.
• The Renter may also terminate the agreement by returning the vehicle before the end of the rental period. Early return may not result in a refund.
13. Governing Law
• This agreement is governed by the laws of the Republic of Mauritius.
• Any disputes arising from this agreement will be subject to the jurisdiction of the courts in Mauritius.
14. Miscellaneous
• The Company is not liable for any personal belongings left in the vehicle during or after the rental period.
• This agreement constitutes the entire agreement between the Company and the Renter and supersedes all prior discussions or agreements.
